1. About these Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "Seller", or "Buyer") and TrustLink Escrow ("TrustLink", "we", "us", or "our"). These Terms govern your access to and use of the TrustLink Escrow website at https://www.trustlinkgh.online, mobile dashboards, WhatsApp assistant bot, and associated payment facilitation features.

In these Terms, the product designation "escrow" refers specifically to TrustLink’s conditional-release software workflow, which ring-fences funds during a transaction until fulfilled or resolved under platform rules.

2. Acceptance of the Terms

By creating an account, generating a TrustLink checkout link, authorizing a Mobile Money payment, or using any part of the service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not access or use the platform.

3. Who may use TrustLink

You may use TrustLink only if you are at least 18 years old or possess legal capacity to form a binding contract under Ghanaian law. If you use TrustLink on behalf of a registered business, enterprise, or merchant, you represent that you have authority to bind that entity to these Terms.

4. Account registration and account security

Sellers must register an account using a valid email address, password, or Google OAuth authentication. You are responsible for keeping your credential details secure. You must immediately notify TrustLink if you suspect unauthorized access to your account. TrustLink is not liable for losses caused by compromised user credentials.

5. What TrustLink provides

TrustLink provides technology infrastructure that allows social commerce sellers to create dynamic payment links, receive payments via integrated Mobile Money gateways (including MTN Mobile Money, Telecel Cash, and AT Money via Moolre), track order delivery statuses, and request withdrawals of earned wallet balances upon buyer delivery confirmation.

6. What TrustLink does not provide

TrustLink is a technology platform, not a bank, deposit-taking institution, savings provider, or licensed trustee. TrustLink does not manufacture, stock, inspect, verify, store, transport, or deliver any goods offered by social media vendors. We do not guarantee the quality, safety, legality, or authenticity of listed items.

7. Creating a protected transaction

A seller creates a protected transaction by specifying item details, price in Ghana Cedis (GH₵), buyer contact number, and agreed fee split. A unique link is generated for sharing in direct messages (WhatsApp, Instagram, TikTok, X). The buyer must review the transaction parameters before initiating payment.

8. Buyer payment responsibilities

Buyers must provide an active Ghanaian Mobile Money phone number capable of approving USSD prompt transfers. Buyers must review the item name, price, and escrow fee prior to authorizing the payment PIN on their handset. TrustLink never prompts for or stores your Mobile Money PIN.

9. Seller description and fulfilment responsibilities

Sellers must describe items accurately without misrepresentation. Upon receiving notification that payment has been successfully escrowed (status: FUNDS_ESCROWED), the seller must dispatch the order promptly according to agreed delivery timelines and mark the transaction as shipped on their dashboard or via the WhatsApp assistant.

10. Delivery, confirmation and release

Upon receiving the package, the buyer must inspect the contents and confirm receipt using their confirmation link or PIN. When the buyer confirms delivery, the transaction status transitions to completed and the net sale amount is credited to the seller's available wallet balance. Payment release depends on buyer confirmation or administrative dispute resolution.

11. Fees and fee allocation

TrustLink currently calculates a 3% transaction service fee. The applicable fee and its allocation between buyer and seller (e.g., 50/50 split, buyer pays 100%, or seller pays 100%) are displayed before payment. TrustLink may update pricing prospectively by publishing the revised fee before a transaction is authorized.

12. Disputes, evidence and transaction holds

If a buyer receives incorrect, damaged, or non-delivered goods, the buyer may trigger the "Raise Dispute" control prior to confirming receipt. Raising a dispute immediately freezes funds in state DISPUTED and flags the transaction for administrative arbitration. Both parties must submit proof (chat transcripts, dispatch receipts, waybills, video unboxing) to enable review.

13. Refunds and failed payment-provider transfers

If a dispute is resolved in favor of the buyer, or if an escrow order is canceled prior to shipping, funds are scheduled for refund to the buyer’s Mobile Money wallet. If a disbursement transfer fails due to payment-gateway network downtime, funds are safely re-credited to the respective account balance pending retry.

14. Identity or account verification

To comply with anti-money laundering regulations and prevent financial fraud, TrustLink may require sellers requesting payouts above threshold limits to verify their phone number, national identity document (e.g., Ghana Card), or business identification.

15. Prohibited transactions and conduct

You may not use TrustLink for illegal activities, including selling counterfeit goods, weapons, controlled substances, illegal financial products, stolen property, or fraudulent schemes. Attempting to bypass platform controls, submitting fraudulent dispute evidence, or manipulating payment webhooks is strictly prohibited.

16. Third-party payment, messaging, hosting and authentication services

TrustLink relies on third-party infrastructure, including Google Firebase (Auth & Firestore), Moolre Fintech payment APIs, Meta WhatsApp Business Cloud API, Twilio SMS services, and live customer support widgets. Your use of these services is subject to their applicable terms and privacy policies.

17. Intellectual property

All logos, brands, software source code, visual designs, database schemas, and documentation on TrustLink Escrow are owned by or licensed to TrustLink. You may not copy, reverse engineer, modify, or redistribute platform assets without prior written consent.

18. Account restriction, suspension and termination

TrustLink reserves the right to suspend or terminate accounts, freeze active escrow links, or restrict access if we detect fraudulent activity, repeated dispute violations, breach of these Terms, or upon lawful order from law enforcement agencies.

19. Service availability and changes

While we strive for high service uptime, TrustLink does not guarantee continuous, uninterrupted access to the platform. We reserve the right to modify, upgrade, or temporarily interrupt services for maintenance, security patches, or feature enhancements.

20. Disclaimers and statutory rights

The platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted under Ghanaian law, TrustLink disclaims all implied warranties. Nothing in these Terms excludes or limits mandatory consumer or statutory rights that cannot be waived under the laws of the Republic of Ghana.

21. Reasonable limitation of liability

To the fullest extent permitted by law, TrustLink’s total aggregate liability for any claims arising from your use of the service is limited to the actual escrow service fee collected by TrustLink on the specific transaction giving rise to the claim.

22. Changes to these Terms

We may update these Terms periodically to reflect product modifications or legal developments. When changes are made, we will update the "Last updated" date at the top of this document. Continued use of TrustLink after updates constitutes acceptance of the revised Terms.

23. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana, without giving effect to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Ghana.
